    I am gob smacked.

    Last year I had discussions with another local firm, I wanted to sell up and move onto pastures new. Anyway, nothing came of it so I am still trying to sctratch a living and having to travel hundreds of miles a week (cos I moved out of my usual area). Its a real battle at the moment, had blow after blow.
    Lost land line number after dispute with phone company.
    Van written off by uninsured driver.
    Lost a good contract.
    Best engineer left.

    Looking in local press this morning found an advert with my business name on it!!!!
    The guys who did not want to buy my business last year have started advertising with my business name right at the top of there ad !!!
    I am P****d off.
    Calling Solicitor today.

    Obviously they are free to use your company name if you did not have it registered. If they are not competing with you for customers then you may be unable to prove that they are doing anything damaging to your profitability, reputation etc. We have something similar in Elgin. There was a firm called Elgin Appliance Centre that closed down then another chap came and opened a shop just called Appliance Centre, so most people think they are dealing with the old established firm.

    The company name was originally registered back in 1972. Under Registration of businesses act 1916. Not sure if that is still current or not, perhaps I should check.
    I certainly seem quiet at the moment so it looks like they are affecting my profitability.
    Going to try Citizens Advise first and see what they say.
    I have to say I think this is low, We spent 35 years building this business and I am buggered if I’ll let these people profir out of our hard work.

    Just checked with companies house.
    Registration of business names act 1916 was repealed in early 80’s.
    No longer a requirement to register.
    Any disputes to be taken to Courts.
