    It seems that NESN are doing the PR job on many of you and spinning one story of one or two of you that is just not true…..

    So to clear the decks and let you know exactly where I stand on NESN and the future…

    I reckon NESN have cost me the best part of £5000 in legal fees so far, countless hours of worry and lost sleep, hardship in the business and I’ve no need to go on as you will get the idea. However you all have your business’s to run and your own workforces to support, so if you choose to return to the NESN network I for one wont hold it against you.
    I would remind you that one of the so called friends is indeed a quisling and he remains untouched in all this, consider asking NESN to name the traitor before you accept work from them….DO US ALL A FAVOUR.

    Remember we (12) (you know who you are) agreed to support one another in the face of NESN pulling tricks on any of the twelve…well your support has been vague and certainly missing. Perhaps you would like to consider a little support now…or do you want the traitor to know all Dasa’s business and carry on using insider knowledge for his own gain..

    Let’s deal with the facts in all this…

    NESN fucked over Kevin good and proper and whilst the events may not have caused the downfall of PKI it potentially could have, but that aside, it most certainly played a part in Kevin and Bridie’s chosen course of action. Okay, so that was all down to Trubshaw you may say, but I doubt he alone had a hand in events and others are still there that did.

    Whoever passed on the letter and, we think we know who it was, betrayed not only a confidence, but his peers and collegues and that, to me is totally unacceptable behaviour. To take Kevin to task over that is still more disgusting, but that’s covered above.

    So here’s what’s going to happen and, frankly, I don’t give a toss if NESN do get to hear it…

    Should Kevin and Bridie not be reimbursed in full I will not work for or endorse NESN in any way, shape or form and if they think it’s all blown over then they better fucking think again. I have a long memory and woe betide anyone that fucks with me or my friends and I consider everyone with access to this forum a friend and, to a degree, we were all shafted. Generally I take the same attitude with other agents as well and I will always do what I can to protect or inform them, hence UKW.

    So far I’ve stayed quiet on the whole subject, they better put it right or I won’t.

    As for my own situation I’ll see how that one pans out. But this is another one of those occasions were WE have to display some moral fibre, some backbone and do what is right.

    If the informant is revealed, even without official coment, fine I can live with that, but it has to be done so we know who cannot be trusted.

    Beyond that it comes down to recompensing those affected by NESN’s previous ruler, when they do that then I would consider talking to them beyond a cursorary meeting.

    And just in case you think it’s all a load of bollocks and has blown over, Ernie just got a court date through as NESN are contesting that they owe him any money which of course they do. I held that conversation earlier today!

    Let’s just say that I am using the current situation as a bargaining tool at the moment, last week I was approached by Jo Lo to do a call, right out of the blue.

    So, I sent her back a reply telling her a few facts and that ammends needed to be made before any progress on that front would be considered. Firstly I wanted an appology for the treatment some of us recieved from NESN, the request was forwarded to the board of directors so I agreed to do the call, which turned out to be a waste of time as we’ed already done it as a chargeable, but that’s bye the bye. You get the picture anyway.

    I recieved an appology from Dave Henry today, albeit a little strained shall we say, I told him I wanted more and named the names of those people who I wanted put right, we’ll see what happens on that front.

    They want work done, they return the favour, even if I don’t get paid, I’ll use the tool of bargaining until such time that ammends are made and matters put right, especially in Kevin’s place, as IMO he has undoubtedly come out the worst in all this.

    So, lets all keep our cool about this and play clever until the leech is named and the debts repaid.

    You asked for some clarification on section 14.1.4 of the Service Provider Agreement. The position is only governed in part by that provision. You gave notice on 8th October 2003 and therefore for the three month notice period to 7th January 2004 were bound by the restrictions in clause 12 of the contract not to work for any of NESN’s clients or former clients directly or indirectly or to assist any other person to deal with those clients or former clients. Now that that period has expired the provisions of 14.1.4 apply. This means that until 6 July 2004 you cannot approach or deal in any way with repair or similar work for any client or former client of NESN. This would include, for example, MFI and Connect Distribution Services Ltd.

    If you breach or have breached these provisions then NESN has the right to take legal action against you to prevent you from approaching or dealing with any of its clients or former clients and for damages and/or an account of profits (which means that you would effectively do the work but at cost price and NESN would collect your profit margin). Obviously it would be in all parties interests if you simply stick to the terms of the contract and do not work for NESN’s clients or former clients until 6 July 2004.

    Just in case you think it was all Trubshaw….refresh yourself on this….Trubshaw did not write the contract….but Nesn were prepared to endorse it…….miss loach sent this barbed reply!

    To now work for them without a contract puts you in the same position as before, you will in law be accepting the only contract they have even though you’ve not signed it…as you know of it

    Forgive me if I’m mistaken here, but I was trying to help, perhaps you are Kev by reminding me of that reply, which I haven’t forgotten believe me 😉

    The reply came from sources above, not the words of miss Loach, sent only via her email address in the form of a Word document as it was her I asked for confirmation of the clause so it was only correct that a reply should come back from her.

    Believe me, my intentions were only to gain the information required to recompense those who have lost, I have no personal bones to pick with Jo Lo or anyone else who remains at NESN for that matter, I do not have it within my nature to lust revenge on anyone, that’s just not in my nature I’m afraid, and if my offer to help put things straight have caused offence, I’m sorry.

    Here’s how I currently see this…

    NESN are trying to make good and they know that if they get back the decent agents or a proportion thereof then they can turn that into a PR victory. Which they are already starting with some of the crap I’ve heard thus far.

    Make no mistake, this Madden woman is out to resurect NESN from the ashes and she appears to be pretty smart but totally oblivious to this industry in some regards. I don’t know her personally but she is taking charge of the situation actively and trying to manage NESN out of the hole they’re in using a bit of spin. Shockingly enough, very similar to tactics previously employed by her predecessor!

    I’m not saying she’s as bad or anything like that, all I’m doing is pointing out a simple unquestionable fact. As is the fact that many that ran the regime under Trubshaw are still there and in a position of power to one extent or another.

    So they approach Jason, Mark, Fitz, Dave and, i assume Phil K as well… all high profile, all previous agents, all resigned and all involved in both DASA and UKW. Do the math. 😉

    Now, let’s look at this from another perspective…

    What has NESN currently got to offer any of us? They have no volume, no cherries in the pie and only bring aggro and low volume, high hassle work and they still will be taking a big “management” fee and paying, at best, “so-so” rates!

    They cannot get any new work as their reputation is shot to shit and to regain some credibility they will use the named parties. More the fool you if you allow yourself to be used like that.

    I’d bet that they still owe every single one of us (bar Dave) some money.

    They have stated in black & white that they will not pay in full till “at least February 2005” every month on top of what’s owing now!

    So, in essence they are going to use YOUR good reputation to put themselves back on the map for work and at the same time use YOUR money to finance that endevour. Very nice if they can pull it off.

    What I would advise is to wait, by all means talk to them, but don’t sign on the dotted line as right now NESN is simply FUBAR.

    Here’s an idea, If they (NESN) have radically changed their modus operandi and are now trying to be open and honest brokers regards supplying work to their members, then why dont they go down the same route that Connect Distribution did when they had the bitter divorce from NESN and started their own network.

    By that I mean why dont they tear up their old discredited contract and submit a new one to DASA for their apraisal an approval as Connect did.

    If they choose not to do this then I would say that nothing has really changed, only some of the names on the doors.

    I would also strongley recommend that anyone who does decide to work for them again does so on a sub contract, job by job basis and stress that no contract is to be inferred.

    Remember the work they took from you, or the work you had to walk away from has been given to others who are also about to be shafted if you decide to go back onboard.

    They are obviousley pissed off with the B TEAM and need the A TEAM back to give themselves some credibility.

    Remember lads for the first time with these buggers you are now in a position of strength. I am not suggesting that you abuse that position but by the same token, dont be in an all fire’d hurry to loose it !

    Good Morning everyone, 😀

    This NESN topic is very interesting, I have an email from Jo stating that she is currently working on a project that will return all post codes to the members that resigned after the Connect fiasco.

    I resigned earlier this year and my three months notice ended in May, so I still have until November before I am released from the clauses within the contract (even though I didn’t sign one)!

    I have been passed several local calls already and have been told by Jo that Ms Madden will be contacting me next week to discuss the way forward!

    I will report back in full once the discussion has taken place. 😀

    hi appboy, good to hear from you again…..

    Whilst not wishing to teach you to suck eggs etc heres a thought for you to consider.

    Connect have brought to this industry (for the 1st time?) a method of payment that in my years in the business has not been equaled or surpassed. They can do this because they are privvy to the insurance database, meaning every job is already a verified call, with practically no exceptions.
    So if Connect can do it…..WHY cant all future contracts you take on do it.Why don’t we as a group insist on it, why do work which does not pay 3 weeks after month end….we have been funding these parasites long enough.

    If Nesn or tom,dick and harry want work doing then the onus is on them to pay my firm for doing it…no more shite no more excuses just pay the bill or go on stop till you pay….

    If we all consider taking a strong stance and collectively adhere to set standards then we will better our lot and all of those who follow.

    Individually we are all relatively weak in relation to these companies who seek our services, however collectively the power will move to us as shortages of good 3 skillset firms increases. I’m not saying we form a union or all join Dasa …..but we are all like minded and we are proprietors who control many engineers…we should begin to work together and be even more open to the work available and price our labour correctly in this fluid market place…

    Some of us have worked well in the past and the £40.00 a call is now a reality, who wants work at £35.00? We now see the next benchmark at £45.00 per call and if we do it collectively we can pull it off…so when Nesn come to call..pitch at £45.00 per call, payment 3 weeks after month end in full(100{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d}) technical and spares back up etc etc

    Then come and let us all know how you got on….

    to all of you thinking or planning to see Nesn in the next few weeks, this is you’re chance to stand up and be counted….they need you far more than you need them, make the most of it , for once

    There are many things to consider and Del’s points are very valid.

    Rates need to improve as do payment terms. The management at the top has changed and they have said so will the work ethics this I have been told is in the process, we need to wait and see. But I dont believe in burning any bridges, you never know what the future holds.

    It too like Kevin cost me a lot of money in solicitors fees and likewise many sleepless nights as Kevin knows. But I personnally put all this down to one person being in control of two other directors, so he always got his way. Now this person has been removed so have many of my fears BUT bridges still need to be built by NESN and its new management.

    CDSL it turning out to be a very good contract for many people , but one thing that we all need to be careful of is too many eggs in one basket. I like others have been caught this way in the past and it is better to be able to dilute your risk with any one work provider slightly so that they dont become too larger proportion of your business.

    no-one will dispute “spreading your risk” but whats the point of that if you do not get paid “in full and on time”

    It seems to me that we have something like the right rate from MFI and the right payment system from CDSL.
    what we need to do now is play them off one another, like they used to do with us lot.
    We need to say well this WP gives me £40 per call and this WP pay’s 100{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} of my invoice bang on the nail.
    We need to hit them over the head with their competitors terms and conditions and demand that they follow suit if they want their work done.

    If a WP cant do either of these, then the next question should be ‘Then what are you doing in our trade ?’

    That said I still believe that it is a big mistake to have one big conglomerate controling all the work, as it is only a matter of time before there is an upset and you find out your back to being a puppett again.

    Why do I give comercial customers a discount from my chargeable rate…

    because they give me steady volume work.

    Right now NESN have neither and they tell me up front they’re not going to pay me properly. Chances of me offering to work for commercail rates with a high double call rate for all that Cornhill shite…

    NONE!
