    Guys,

Do you want me to draft a letter to send to the various manufacturers or does one of you want to do it?

We have to move on this, like now.

I will need a scan of Lawrence’s signature.

And an hour or so to make something up that fits. :rolls:

    Re: OFT Investigation

    Okay, started for 10…

    Dear XXXXXX,

Several of our members have written to you in recent months concerning the release of spares as well as technical information and any specialist diagnostic equipment as advised by Defra under Regulation 17 the WEEE Directive. This regulation states that any manufacturer has a legal obligation to make this information and equipment available to any interested parties within the industry.

No response has been received in response to these requests.

You may have seen in recent days that the OFT has also launched an investigation into Domestic Electrical Goods (DEGs). The OFT has also asked that we clarify the position in regard to this information and equipment.

Given that we must officially respond to the OFT’s inquiry prior to 12th January 2011 I would formally request that you please respond to the letter by 20th December with your company’s position on these matters so that we may report back to the OFT and Defra.

We shall accept no response as a position of “no comment” on the matter and a refusal to make this information and equipment available to trade members in general.

Please do also be aware that under EU Regulations that it may not be possible to charge any more than is charged to your own dealers or employees for this information and equipment or access to such.

Your comments would be appreciated in a timely manner to allow us to report back to the various government bodies that are interested in these matters.

Should you require any further information please feel free to contact myself directly as listed below.

    Your faithfully

    Lawrence Carey

Should shake them up a bit.

But, in many ways, I actually hope they ignore it.

    Take 2…

    Dear XXXXXX,

Several of our members have written to you in recent months concerning the release of spares as well as technical information and any specialist diagnostic equipment as advised by Defra under Regulation 17 the WEEE Directive. This regulation states that any manufacturer has a legal obligation to make this information and equipment available to any interested parties within the industry.

No response has been received to these requests from our members prompting the need to contact you directly in an official capacity.

You may have also seen in recent days that the OFT has also launched an investigation into Domestic Electrical Goods (DEGs). The OFT has also asked that we clarify the position in regard to this information and equipment as part of the scope of this investigation which encompasses after sales service etc.

Given that we must officially respond to the OFT’s inquiry prior to 12th January 2011 I would formally request that you please respond to the letter by 20th December with your company’s position on these matters so that we may report back to the OFT and Defra.

We shall accept no response as a position of “no comment” on the matter and a refusal to make this information and equipment available to trade members in general and, specifically, to our members.

Please do also be aware that under EU Regulations that it may not be possible to charge any more than is charged to your own authorised dealers or employees for access to this information and equipment. Although this may require clarification there is already precedent in EU Legislation to support this position.

The specific information required is as follows:

Is technical information available for your products and, if so, where do we direct our members to access this information?
Where are spares available at a trade discount?
Are any specialist diagnostic, reprogramming or setup tools or software required to service and recondition your appliances?
If specialist tools, software or equipment is required where are they available to trade members?
What are the costs for each of the above?
Are subscriptions required to access this information as it is updated and, if so, what is the ongoing cost of this?

Your comments would be appreciated in a timely manner to allow us to report back to the various government bodies that are interested in these matters.

Should you require any further information please feel free to contact myself directly as listed below.

    Your faithfully

    Re: OFT Investigation

I think a mobile number on an ‘Official’ document from a TA looks a bit unprofessional TBH.

I’d stick UKW number on it, and if Lawrence gets a call, take a name & number then Lawrence can call them back?

The letter looks good though IMO

    Ade 🙂
