KeymasterWe fitted a PCB modification kit to a fridge freezer, tested the machine it seemed to be working and charged the customer, £150 for the complete job,
Two weeks later she phoned back and said the fridge freezer was playing up again, as she didn’t want any more money out, we said that we could either come out and take the parts out and refund her on the part, or supply and fit a new fridge freezer and take off the price paid for the part.
I therefore quoted her £500.00 for the new integrated fridge freezer fully fitted less the price of the part. So she would have to pay £410.00
This to me seems quite clear, however somehow the customer believed that she would have to pay the full £500.00 thought this was expensive and went elsewhere, and has dumped the old machine.However she has phoned me this morning asking for a refund on the part as it hadn’t worked, I tried to explain that I couldn’t refund on a part that she has thrown away , she argued that it wasn’t made clear that I would need the part back in order to refund her !!
My response to this was that if she purchased a kettle from somewhere and it broke after two weeks she would have to take it back to where she bought it in order to get a refund, she said she understood this but this case was different , and if I didn’t refund her she would go to trading standards etc etc…

This makes me think of the last episode of ” The Sheriffs are coming” Where a woman sued the place she bought a van from and won and the sheriffs went to collect and got the money
When they spoke to the garage owner he said he had been waiting for her to bring the van back before giving her the money but she had already “disposed” of it.
I didn’t think it was fair that she got her money back and didn’t have to return the van. But the same may apply to your situation?

If she were to issue a county court claim, without an independent report showing the repair was unsuccessful, I doubt a judge would rule in her favour. However, if appleelectrics did not file a defence within the deadline, then she could enter a judgement against him “by default” and ask the bailiffs to enforce the judgement.
There is of course a possibility the repair worked fine and she still has the appliance!

its was quite interesting to see that programme about the bailiffs , we dont have them in scotland , got sheriff officers etc
did you see the one where it shows you you dont have to let bailiffs in your property , but if the door is not locked they can walk in peacefully and start listing your stuff for sale.
so if the bailiffs are chasing you lesson lock your door ..
also check the if its the official paper work correctly signed and dated
