ParticipantI went to customer on th 26/05/09, unblocked the machine of coins and the usual.
The cheque paid for £38 bounces.
I ring in June, July, August & September to get money. The money is promised but never arrives.
A call from the customer comes in today…. she is saying the machine hasn’t worked since I went six weeks ago.
I tell her it was nearly 5 months ago as I have had her bounced cheque staring at me on my office desk.
She says she not going to start talking dates.
I ask why she never told me it wasn’t working when I spoke to her or her adult daughters over the past 4 months.
Anyway apparently shes phoning Watchdog on Monday because I won’t go out to fix it.
How to ruin a pretty calm Saturday.

threaten her with small claimes court, that should do it

i had similar about ten years ago sold a recon washer and fridge freezer for 250 quid cheque bounced and try as i might i couldnt get the money back 4 months later she rings saying washer has gone wrong and can we call to repair it she just couldnt understand why i wouldnt call and started quoting all sorts of imaginary consumer laws to try and get me to go . After about ten mins of heated discussion she anounces that she will never use me again :rolls: at that point i fell about laughing and put the phone down ,got to admire there brass neck though :rolls: . Best thing to do though is ring all your local competition and warn them about her that way she will have a long time to wait to get it fixed 😆 thats what i did 😀

The only answer is never accept a cheque without a card as backu 😯 I do it ALL the time myself thoug 😳

similar experience,no payment after 6 months and I rang,she said it was never right.
OK I’ll call in sometime,called in and just the daughter so said it’ll have to go back to the workshop for further tests 🙂
Probably wrong but the shoe was on the other foot,is it OK she rang and asked,yes just fine,as it was origionally,when can you bring it back?when you call and pay up front.never called bar her asking again before christmas 18 months ago ,same result no money forthcoming so used to loan to someone,still there 😯October 11, 2009 at 9:49 am #299231Phidom

Perhaps I have just been lucky but I’ve not had any bouncy cheques since I started in 1998.

After a bounced cheque I write giving 7 days to repay.
Then if nothing they get a 14 day notice of prosecution.
If no reply issue summons to court.
Go to court and get a CCJ issued.
You cannot always get cash back, but in the 5 times its happened to me only once did it get to court and the guy threw the cheque accross the table at the Judge, who fined him for contempt in Court. 😆 :rolls:
That was funny.
Its also illegal to issue a cheque with the intention of not paying, its fraud.

hi lee what is this 14 day notice to prosecute you spoke about in the thread is it just a letter or do you use something formal as i have a bounce chq at the mo?

Its a letter from either yourselves or your solicitor.
Simply write the format as a letter, but in bold accross the top under the address details such as this below.
Mrs Smith

Dear Mrs Cheap scate,BLAH BLAH Blah.
You have to send nice friendly letters first as its possible the client may have misled them or has a genuine reason for not responding.
After the first few, normally 4, but I don`t wait that long you will need a letter of intent which is worded strongly and slightly aggressive, but not too much, keep it to the actions the law will allow you to take ie issue a CCJ and or remove goods, attachment to earnings etc etc.
Once notice is issued you have to follow through on time, issuing a summons a month after a 14 day notice is not good.
And be prepared that Mrs Skint may no the court procedures better than you and will exploit any mistakes you make.
Not all non payers are genuine, some are smart and have done it before.
The world I`m afraid is full of nut jobs. :rolls:
