KeymasterOne of the contactors we use fitted a new machine into a flat back in July , the Neff machine coming out was quite new so he used the existing fill hose and just changed the washers, he done a full water test and it was all ok,
At the end of October the hose started leaking at the neck joint and leaked into the flat below, the landlord is trying to claim the damage from the fitter saying he should have changed the hose.

Yep
Sorry I have to agree he should have changed the hoses.especially when installed into a flat.Also the old hoses was an un known verifiable age..may look new but may be 5 yrs old.

Just out of interest,how does the landlord know the hose wasn’t changed?

We have had this happen with new hoses as well, particularly some supplied with machines of Chinese Manufacture.
Agree with Tim above, how does he know that the hose wasn’t changed??

Well he either saw the installation being done or was told, matters not really, he knows about so no defence there.
Had he fitted the new hose and that has failed then the manufacturer of the machine would have been liable. Then you get into the argument of was it fitted correctly if it was a new hose.
One very good reason to have decent public liability insurance, if you feel you are not at fault then they will investigate. If you admit to not having fitted the new hose you are stuffed.
