    Not sure where to find advice about this. I bought a Cuisina microwave from Comet in September 2012 and now the turn table doesn’t go around. Comet won’t replace, their supplier won’t replace, what do I do next?

    Buy a new one, it wont be worth fixing and as you have found out the warranty is no more as the retailer dosnt exist anymore.

    We’ve had a spate of people asking about appliances bought from Comet usually along the lines of, “what are you going to do about it?”.

    This confused us greatly for a time.

    Until we found out that Comet staff were Googling the brand to find out who owned it, which tells you a lot about their staff knowledge but, that aside, they then have been telling people to call us as they found us on Google. Wrongly assuming that we (UKW) was somehow the manufacturer of all these products.

    We’re not.

    Eurolec is a brand that was owned by PABL who went bust (IIRC) in 2008 and if the people looking took the trouble to actually read the information about them on this page then they’d see that and, that we have absolutely not a thing whatsoever to do with the Eurolec brand. At all. Ever.

    The brand is dead and has been for a few years.

    So, what we think has happened is that the administrator has discovered a bunch of old stock (or Comet has before they went pop) that they had laying about and they’ve decided to flog it off on the cheap. Probably not realising that there was absolutely no manufacturer warranty support in any shape or form.

    That means that, under the SoGA that your only recourse is to go to Comet and try to get some sort of resolution. Which, I wouldn’t hold out much hope of given that it’s a product from a manufacturer that no longer trades from a retailer that’s in administration and the cost of going to court over it would be silly compared to the purchase price of a massively discounted appliance.

    That’s the problem with buying liquidated stock, you’ve no chance of getting anywhere I’m afraid and, even if you could or wanted to try purely on principle, by the time it got into a court the company will likely no longer exist.

    Therefore my advice would be, chalk it up to experience, buy a replacement and move on.

    When Comet appointed the administrator, the legal effect was to cease that business forthwith, from that second it no longer existed.

    A new co would have been formed by the administrator, the administrator then trades the company until they turn it into a liquidation or sell it to a third company. The administrator has certain privileges and some protection from claims for faulty/damaged goods.

    Now the problem you have is as the original Comet Co no longer exists the buyer has no ability to claim from them under the SoGA. The Comet Co in administration will only last a few months and will fob you off where ever possible and once it sells or transfers to Liquidation status, the In Administration company also ceases to exist so there can be no further claims under the SoGA with them.

    If it is sold usually to a third company lets say Comet 2013 Ltd then they refuse to accept any liability as technically they didn’t sell it. Sometimes the buyer will accept the liabilities if its negotiated within the sale but those are usually ore agreed packaged ones, which this isn’t.

    Unless you can trace a willing manufacturer to honour a warranty then your pretty much stuffed.

    This is why sometimes administrators sell off stick cheap, because they have no liability for it once the sale has gone through, Caveat Emptor!!!!!

    Hope this makes some sense.

    DrDill is IMHO correct, dump it and buy another I am afraid.
