ParticipantWell today I had the inevitable phone call, from Jo Lo, yes she went back to work after all.
She wanted to know what could be done to resolve the differences between NESN and myself. 😯
Apparently JT has got involved along with Nic Cooper and according to him (JT), I should be left to cool off over the weekend and then Jo Lo is to phone me Monday “with a big hug” and everything will be alright. (Fuckin arrogant twat 👿 )Why she told me this I don’t realy know, she is almost being too pally with me, which is worrying.
According to her, many of the top performers in the network, as far as WIP/KPI go have either already given notice, have NESN on stop or are VERY pissed off with them. Now, as we all know NESN use these figures as a selling tool to gain new contracts, keep existing contracts etc, so they are very worried at the moment, it seems they are surviving by grabbing anyone they can to fulfill their contractual obligations.
Example: they have NO gas cover at all in Devon, and this ain’t a small County.
Anyway, I told her I cannot see a way that I can continue working for a company that I no longer trust, contractually or financialy, not only did they take 50{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} of my area last year without former notification (breach of contract), pay 60{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d}-70{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} each month with no definite date of the balance being paid (another breach of contract) totally fuck up on the shares payments and certificate issue (in breach of English Company Law).
On top of that I have had legal threats from JT to “shut up” on the white goods email list and on this site, and now he is threatening collegues with a clause in a contract wich basically I wouldn’t wipe my arse with.
I’ll let you know what the conversation holds on Monday, if it happens, and I wonder who will make the call. If JT offers me a hug, someone had better have a bucket close to hand. 😮

Participantwell thursday was the last day of the contract between mfi and nesn so after much thought i phoned jt to imform him that my company was to start working direct with mfi.this means that i have to leave nesn well i hope i have made to right choice?this is interesting as some people are being told that you can do both contracts with any reprocussions.

KeymasterIs there more than one instance of this Mark? If so I’m sure between myself, Kev and Dave we could really have a field day with JT in the forums, without being specific on companies involved of course. 😉
I like to brighten his day every now and again and this is simply another example of “if your face fits”.

Get the picture?
However, having your hand forced is tantamount to the same thing IMO and the threat should have never been made in the first place.

ParticipantJ.T came to see me yesterday, and clearly said that he was on a witch hunt for members doing MFI work. There would be no exceptions, they will be terminated.
He also went on to say he would sue anyone who breaks their contract.
J.T said Mark had decided to leave the network and he was sorry to loose him.
His visit to me was really a big PR job, with promises of great things!
The hub and spoke idead was aired again, and he really sees this as the way forward.
I have been left with a lot to think about, I will be speaking to you all during the week for your input.

KeymasterOh how dearly I would love to take the gloves off with NESN, but Mark won’t let me! 😉
Let me surmise, they (he) are a shower of manipulative, devious shitbags that think they can control the trade and control their agents to have them do as they will. They do this by means of a contract, which they break repeatedly and yet expect you to uphold your side of it. Meanwhile the parasites are fleecing you out of about 25{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} of the labour fee to “manage” the calls! Manage what? Can anyone honestly tell me that they are managing the calls on their behalf?
All they are doing is taking a slice like that for passing the call through to you, centralising the invoicing and producing some reports for clients. As far as I can see that’s all they do for the money.
Now with the advent of Network DASA the balance of power may well shift, in fact I think it will, even if it takes some time to do so. Shame that anyone that is in NESN will be unable to join with ND isn’t it or you’re in breach of contract and our friends there will sue? Just another method of control, nothing more, so they gain an employed workforce without the responsibility of an employer.

ParticipantI have just spent a couple of hours with Darren Harrison in his new role as National Accounts Manager for Whirlpool.
We had a very interesting conversation about his old firm and their future. 😯With this new information, and the kind advice from fellow DASA members, I have now decided to decline the NESN offer of work and other great things. 😀
Please inform our friends in Cumbria of my decission, I am sure it will make their day! 😀

Participantwell men I am now on notice until december the 31st.must add they only owe me about 8k now you can say what you like now.phil i hope in a years time we all can look back at this time and reflect that our choices were the right ones.

ParticipantAs I am not doing the MFI work JT has no hold over me as far as contract agreements go, and as they have breeched their contract with me more than once, I may well take the approach of terminating them with immediete effect (when the time is right 😉 ), untill then the work in my area is being passed elsewhere anyway.
Perhaps I’ll get a call asking if I want to be a hub, my answer: “On yer bike”
BTW Phil, you have my full backing on your decision, I’m sure you have made the right choice. Assuming Darren wasn’t just making a social visit, you are set to pick up a bit of work in that direction I guess, which will more than compensate for any work lost from our friends in SOS
