ParticipantWell I got a letter today to say driver of said van was smoking, I now have to tell them said driver,prove that I have no smoking signs in said vehicle.
I can be fined up to £2,500.00 for failing to prevent people from smoking in my vehicles.
I can be fined a £1,000.00 for not prominently displaying such signs or a fixed penalty of £200.00, and a £50.00 fixed fine for the driver.
So now another lot of paper work to do just line the goverments coffers.
This seems to be done on camera’s though the letter does state Enforcement officers will have the powers to issue fixed penalty notices.

Assume this was an official letter?
I thought as with truck drivers that if the cab was for single use, and not shared or a pool vehicle, there was not a problem.
How many white vans do we see with one occupant smoking and the other is not? It is very common.

Yes it is an official letter, it was from Maidstone Borough Council http://www.digitalmaidstone.co.uk Thanks for the sticker offer but they are in the vans,in the letter it states one in each compartment?
So why are we persecuted and not company cars drivers?

AlexI am sure Alex is correct.
How many people were in the vehicle?
Is it used by more than one person?

Do the regulations include all work vehicles?
Where a vehicle is used for work by more than one person, regardless of whether they are in the vehicle at the same time, it will be required to be smokefree at all times. This protects all who use the vehicle from harmful secondhand smoke, regardless of when they use the vehicle.Smoking will be permitted in vehicles that are for the sole use of the driver and are not used as a workplace by anyone else, either as a driver or passenger.
