WEEE Directive
Thank you very much for your email concerning the problems you are experiencing as a result of the transposition of WEEE directive into UK legislation. I was very sorry to hear of the difficulties you are experiencing.
A few general points may be helpful. Once a European Directive has been agreed, there is then a requirement for each member state to transpose this into their own national law. Because each member state has a different system and process by which this is done, there are from time to time certain difficulties which are thrown up. Either a member state can fail to adequately transpose it, with the result that the original intention of the EU legislation is not fully carried out, or in other cases, there is what is called ‘gold-plating’ this means that member states unnecessarily adds restrictions or requirements which are not directly called for under the EU legislation itself.
I have forwarded your concerns to the European Commission to ask for their comments as to whether the UK government has acted in accordance with the requirements of the EU directive in the this case, and of course I will get back to you as soon as I receive a response.
I am copying this letter to your Westminster MP Nick Palmer for information.
