No that makes perfect sense to me Rudolph.

Given that this is purely hypothetical, if the said party from paragraph two were actually living in the real world and not in a hypothetical question, then would they not be better placed if they actually had some respect from it’s agents before the hypothetical situation arose, or perhaps the hypothetical situation would never have risen in the first place.

If you ask me paragraph two would have to be pretty hypathetical to allow this to happen at all.

No I’ve been away for some time as well and it has taken some time to catch up, this one caught my eye though.

I think most points of the said letter have been covered by Rudolph, but one point rather stands out:

To coherse anyone into discussing a contractual subject would be deemed to be in breech of such a conract, which is one thing that the said contract prohibits, so would someone like to answer the question please:

Why is the person who drives the oddly shaped German vehicle so obsessed with protecting his own interests, when on the other hand he can openly invite a deliberate breech of conract by discussion, and at the same time threaten their only asset (the members) with legal action in the courts for a lesser action (ie, earning a living),

So that would mean that the WP in sos (phooarr) will not now be picking up the work left behind by Endeva as they promised their members, or was that just another poor attempt at boosting morale.

It is another sad reflection on a network that has in one way or another totally alienated and disillusioned it’s members, do they honestly expect to pick up any new lucrative contracts with such a poor attitude toward the people it could not survive without.

    Evidently not.

    As ever, just an observation.

That just about says it all really, untill late last year sos (phew) would no doubt have had support from virtually all of it’s members. But when they start taking huge chunks of peoples area without notification, withold monies owed, threaten the very core of their business (their own members) with a law suit if they should even think about working for anyone else and then they try to shut people up when they talk to each other.

That is just a few of the many nails already in the coffin.

Think about this though, this month they have managed to pay all their members 100{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} according to them, this is in fact false, if you would care to check your credit notes for a decrease in advance balance, I dare say it is quite high, or higher than normal, check this amount against any rejected calls you recieved this month, I think you will find it doesn’t add up somehow. 100{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} ? I don’t think so, just a very shrewd accountancy trick to stop the rot setting in any further, keep a few members sweet for one more month, what will they try next month ???

So, looking at this in a basic way, if you no longer work for a particular work provider, and they have within their contract a clause telling you that you cannot work, under any circumstances for any manufacturer, insurance company or retailer that they also provide a service for, within a period of say 12 months, for arguments sake, after the agreement is terminated from either party, this is “on paper” sue-able.

But, if the manufacturer/insurer/retailer then has a “hole” in their coverage and they contact the ex-agent directly, there is nothing whatsoever to stop a new agreement being struck between those two parties.

A most interesting slant on recent threats that have been abound by a certain nationwide electronic stupid network.

Regretfully this will strengthen the case for the parts provider to short-cut the system, as mentioned before.

Only in as much as the newly appointed network manager.

It has come to light today via a company representitive that the two companies mentioned as the subject of this thread will be very likely to part company, as one is very unhappy with the other’s performance.

It’s up to you to decide which side is the unhappy party, but it shouldn’t be too difficult.

It would seem that the company concerned are just trying to find any excuse for their recent poor performance in keeping their customers and members happy.

I think to use this site and the mailing list as a scapegoat is inclining toward the ludicrous.

Talk about burying your head in the sand, perhaps they should rename themselves ???O with the last word being Ostrich.

Yes it is true, and if another rumour is true they are not doing a very good job either.

Why the company in question has not taken the extra money off of their management fee is ridiculous, they can’t handle the work, so those of you working for them stump the bill.

Where will it all end I wonder

The said network director also happens to be an ex Mastercare/Coverplan manager, this should tell you that they will be setting up a Coverplan network to work directly with agents, whether this involves NESN or not remains to be seen.

In addition to this one of the main NESN accounts guys, Shaun Mckinney took a fortnights holiday then promptly resigned.
