I find myself in the strange position in this case of having to report the news as well as being a part of the news but I’ll do as best I can to remain as impartial as I can.

NW Appliance Repairs Ltd (NWAR) carried out some work on behalf of Bradshaws (later to become a part of the Plyanemca Group) between October 2001 and March 2002 on some refrigeration and commercial microwaves. A final account was sent to Bradshaws in October of 2002 leaving NWAR with unused spares that were to be returned for credit.

The final invoice was rejected, at first it was claimed that Bradshaws would not accept a “batched” invoice and, later, Bradshaws stated that the worksheets that were originally attached and not returned to NWAR, were not received with the original invoice.

NWAR refused to pay Bradshaws for outstanding spares used on repairs carried out on their behalf.

Bradshaws proceeded to raise an action in the small claims court against NWAR early in 2005 for outstanding amounts owed. This despite the fact that NWAR had offered to “write-off” the, approximately £200, sum that would be owed to NWAR on contra. That offer was totally rejected by Bradshaws and they proceeded with the legal action.

The case was heard on Tuesday in Bristol County Court where the judge agreed with NWAR’s version of events and ruled in their favour, awarding £500 in costs as well as decreeing that Bradshaws would have to pick up the spares that were being claimed for credit.
