I have just had a call to say that the manufacturers are trying to say that the control dial was in the off position and therefore could not have been on at the time of the fire.
CLUTCHING AT STRAWS OR WHAT.That doesn’t mean that the dryer still didn’t “time out” after the alleged fire took hold.
Will watch with interest, I hope it all goes well for you.

As well as the above, which is very possible; even if the machine is not in use, a mains power supply is still present. There may not be any current being drawn at the time but there is an interference capacitor which is the 1st point on the appliance. That is always reading a potential difference and a likely reason for fire.
There have been instances in the past where these mains capacitors will combust for no apparant reason.
Just a thought and I’m sure the forensics team will look at ALL possibilities.

ParticipantThanks for that Alex.
However, the machine was in use. When you think that the time between my boys running out of the house and the fire brigade arriving, the problems inside the machine would have been on the go for a while and the dial would have timed out.
I have a photograph taken by the fire brigade on the night which clearly shows the dial NEARING the O and further to this.. the forensic report states that THE 13A FUSE WAS FOUND TO HAVE “BLOWN”. Need I explain anymore?
I was advised by the London Fire Brigade on the night that they suspected the new tumble dryer was the cause but they were not able to confirm this until they got an independent investigation on this and did so. The forensic report was independent of me. I did not appoint them, the London Fire Brigade did. I cannot see how they can argue with the London Fire Brigade can you?Judy Benoit Milner

Judy,
Any news or updates on this from Costco or Whirlpool yet?

ParticipantSorry guys for not being in touch. We’ve been on the road and have not been able to access the internet all the time.
Anyway, Whirlpool have been waiting to get into the house to do tests. For obvious reasons, we had been reluctant to give them access without being accompanied by a forensic scientist appointed by us. We felt this was the most sensible way to proceed however, we were waiting for some other matters to be cleared before hand and Whirlpool made it quite clear that they were less than happy about it (putting it mildly).
Thankfully, after so many days of waiting, an appointment was been made for everyone to access the property on Thursday so I cannot say or do anymore until the forensic findings have been reported. Let’s hope they make a decision after that.Life in the Benoit Milner family has become so very difficult. Thankfully, I have a good family and many friends to support us but it is so hard when my children look me in the face and ask “Mum, why don’t Whirlpool care about us?” Sadly, I can’t answer this, I just do all I can to reassure them that we love them and we have a lot of support behind us, we just have to see what they say after Thursday.
I’ll be back then.

Hi Judy,
As we had’nt heard from you in a while we were kind of working on the premiss – ‘No news is good news’ kind of thing.
Well you have some news to impart at least so that’s good. I wonder how much influence your appearing on BBC’s Watchdog help the cause along? And of course your article on this site has attracted ‘Google’ high rankings for weeks, so half the world should have read about your case.
And as this case now is ‘public domain’ I wonder if you could send us some pictures (e-mail to me direct is best) to publish on this site?
As always GOOD LUCK and keep posting, soon with a happy resolve we hope.
Regards

Of course Martin. No problem about the pictures. I’ll email you some now, I also have also posted them all to the net and will email the link for you to access them yourself.
I am still working on posting a website with the entire story, all the evidence, reports and photos soon.

I thought I should update everyone as to where we are.
NO WHERE…. 👿 WHIRLPOOL HAVE NOT YET CONCLUDED THEIR INVESTIGATIONS and while these unreasonable delays continue… WE ARE STILL HOMELESS.
I have had enough of living in cramped, unsuitable conditions… I have had enough of my kids asking me WHY WHIRLPOOL DON’T CARE ABOUT US. I have had enough of tests upon tests which ultimately show that the fire was not caused by user misuse but they just keeps asking to test something else.
Surely they don’t think I am going to let up on this???? perhaps Whirlpool need reminding THIS IS MY HOME… THE ONLY HOME MY SELF AND FAMILY HAVE… WE HAVE BEEN SEPARATED FOR 18 WEEKS AND NOONE SEEMS TO CARE. WHY DO WE HAVE TO HAVE THESE UNREASONABLE DELAYS? WHY DO WE HAVE TO KEEP ON WAITING?? HOW MUCH LONGER DO WE HAVE TO WAIT OR WHAT DO WE HAVE TO RESORT TO TO GET THEM TO HELP US? I BELIEVED WHIRPOOL TO BE A REPUTATBLE COMPANY WHO CARED FOR IT’S CUSTOMERS…. CAN THIS BE TRUE IF THEY CONTINUE TO LEAVE US HOMELESS?????…

Hi Judy,
Correct me if I’m wrong but haven’t the forensic investigators established beyond all doubt that the cause(source) of your fire WAS the Whirlpool Dryer? Or is this still conjecture, with them(Whirlpool) still arguing the case against?
I thought from what I saw on BBC’s Watchdog that it seemed pretty conclusive, and that the fault was indeed the dryer? Presumably you have kept the BBC up to date?
Sorry to frustrate you even more with questions at this time, I sympatise greatly with you and your family of course over this terrible situation.
I wish there was more that we at UKW could do for you?

The Forensics appointed by the fire brigade concluded that the fire started inside the machine but only by examining the dryer itself.
The examination of the house has only now been concluded but I heard that WHIRLPOOL may not create the final report until they interview the experts who were at the scene on the night. To date, I have had….
1. London Fire Brigade report that the tumble dryer was the probable cause.
2. Forensic Scientists Casella Stanger examine and conclude that the fire pattern was consistant with a fire starting from inside the machine.
3. Our forensic scientists conclusions agree with the above findings after examining both the tumble dryer and the house… TWICE.
4. Whirlpool search my house TWICE and not finding anything which could point the blame elsewhere after checking the fuse box etc. but still not drawing a close to their investigations. My problem is… neither the Fire Brigade’s scientists nor our scientists or Whirlpool can pin point why it caught fire and therefore it lays us open for further investigation.
I would have thought that if it was agreed that the fire started inside the dryer, that the rest is frankly none of my concern.
WE JUST WANT TO BE HOME AGAIN AS A FAMILY…. My husband is having a breakdown, I have just been asked to move on from where we were staying at my friends house and am forced to find alternative accommodation. Right this minute, I have a car fulll of stuff belonging to daughter, my young son and myself and no where to go. My husband is looking after the office so we HARDLY see him.
MY FAMILY IS SPLIT UP AND EVERYONE SEEMS TO DRAG THEIR HEALS. WHAT DO YOU WANT FROM ME WHIRLPOOL?????
ARE YOU FORCING ME TO CAMP OUT IN MY OWN BACK YARD????
WHIRLPOOL, WE HAVE NO ELECTRICS, NO GAS, WINDOWS ARE BROKEN, RUBBISH IS STILL IN THE HOUSE SINCE JANUARY 6TH, EVERYTHING STINKS OF ROTTING FOOD AND SMOKE DAMAGE,
WHIRLPOOL, WE WILL HAVE TO REPLACE EVERY STICK OF FURNITURE IN THE HOUSE, WE WILL HAVE TO STEAM BLAST THE WALLS, REPLACE THE FLOORING,
WHIRLPOOL, WE WILL HAVE TO REPLACE ALL OUR PRECIOUS ITEMS LOST BY WATER DAMAGE AND SMOKE,
WHIRLPOOL, SURELY YOU ARE NOT FORCING US TO BECOME SQUATTERS IN OUR OWN HOME????
WHIRLPOOL, WHY IS THIS NOT MOVING ON FASTER?????
WHIRLPOOL, HOW MUCH LONGER MUST YOU KEEP US WAITING??????
WHIRLPOOL, HOW MUCH LONGER MUST WE BE HOMELESS??????
WHIRLPOOL, MY LIFE, MY FAMILY, MY WHOLE EXISTENCE IS BEING DESTROYED AND ALL I WANTED WAS A RELIABLE TUMBLE DRYER FROM A REPUTABLE COMPANY, IS THIS REALLY FAIR???????
WHIRLPOOL, IS THIS GOOD PUBLIC RELATIONS???????????👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿 👿

Judy,
Please do not forget that the supplying dealer (which I believe is Costco in this case?) bears the ultimate responsibility for the damaged/faulty goods. It was they that sold you the goods in question and they that should recompense you for the damage. Your ‘contract’ is with them and not necessarily with Whirlpool!
I realise your dreadful predicament and sense the obvious frustration within your recent postings. Forgive the seemingly impertinence of my final question(it is not meant that way I can assure you). Could you not seek ‘Legal Aid’ and sue the supplying dealer? When a law suit is slapped on someones desk they sure do jump into life pretty quickly and deal with the matter.

ParticipantMartin… please do not think my anger is directed to anyone other than WHIRLPOOL and COSTCO. Everyone on UK Whitegoods have been very understanding and I appreciate everything that has been suggested and said.
I am not doing this on my own. I have a solicitor dealing with everything who is doing this on a NO WIN NO FEE basis… that is how confident he is of winning . No need to wait for legal aid but we are trying to give Whirlpool the chance to come clean and compensate us. They are business men and therefore I believe they know it doesn’t pay to keep us in this terrible situation for very much longer. Interestingly.. they have managed to keeps us waiting until the WATCHDOG Series has ended … the last show was this week. Thank god for UK WHITEGOODS is not closing down for the summer.
All we can do is be as accommodating as possible as I just cannot believe that they will try to cheat their way out of this… they have a big reputation at stake, they are a well known brand name so surely they don’t want the brand name tarnished especially if it transpires that my tumble dryer was a rogue machine. The design may not be at fault at all although they seem to have a hell of a lot of plastic located up in combustible areas of the dryer but I am no tumble dryer expert so I cannot of course be sure. Anyone can accept that these machines are made by man and sometimes things go wrong… everyone it seems but WHIRLPOOL.
I have a lot of people eager to help me if it looks like this will go on much longer.
You know.. I heard IKEA’s whitegoods are all WHIRLPOOL. Interesting eh?JBM

Thanks for your reply Judy,
I am glad a solicitor is on the case and I am sure that things are headed in the right direction. It appears to me to be a clear cut case for a Court of Law to make judgement by now and apportion blame so that you can put forward your claim and get your life back together!
If however your solicitor is pursuing a private claim for damages, that could drag on and on by being just a paper shuffling exercise between COSTCO and WHIRLPOOL!

Agreed Martin. My solicitor won’t take no crap from Whirpool or Costco. We just want to be fair and give them a chance see that this an authentic claim.
My anger now has been generated by the time wasting going over proven tests, demands and repeat reports and interviews and what seems like a total lack of trust in the London Fire Brigade’s report.
Frankly… I cannot see how people can question the LFB… They have to be the most impartial participants in this entire enquiry.
COME ON WHIRLPOOL…. SHOW US YOU CARE…. WE ARE HOMELESS 🙁 DO YOU KNOW WHAT THAT MEANS??? NO WHERE TO LIVE, OUT OF OUR HOME WE SPENT TWENTY YEARS TO CREATE, FAMILY SPLIT UP FOR 18 WEEKS, MEMORIES DISTROYED, ALL PROPERTY DISTROYED, I AM STILL TRYING TO CLEAN UP STUFF WE MANAGED TO RESCUE BUT ARE UNUSABLE BECAUSE OF THE PIERCING FIRE SMELL. DO YOU KNOW WHAT IT IS LIKE TO LOOSE EVERYTHING YOU HAVE IN YOUR HOME? BE FORCED OUT OF YOUR HOME FOR SUCH A LONG TIME?
WHIRLPOOL, JUST GO HOME THIS EVENING AND TAKE A GOOD LOOK AT EVERYTHING YOU HAVE IN EACH ROOM… LOOK VERY CAREFULLY, GO THROUGH EVERY DRAW AND THEN ADD WHAT ITEMS YOU WOULD HAVE ACQUIRED JUST AFTER CHRISTMAS AND DAYS AFTER A WEDDING AND THEN IMAGINE IT ALL GOING UP IN SMOKE.
Well. we do not have to imagine… this is reality to the Benoit Milner family and our life in the year 2004… what a horrible year it has been.

Just interested how this panned out in the end?
Does anyone still have the .wmv from the WatchDog site?
Did a website ever get created?
Did Judy ever update the way it all ended?
