    We discussed this a long time ago, while NESN were lobbing threats of legal action about as if it were a daily routine and I totally agree that a war chest, as we reffered to it previously, is a superb idea. Th eproblem is that you need people to participate in order for it to become useful. But even with 50 of us chucking in £100 every couple of years which is really not a lot of money in business terms, offfers a substantial £5000 just to start with and in theory you could work a deal with a firm of solicitors to deal with such matters.

    That said, the point is not to have to use it and there should really be no need to use it, certainly not as a threat. What it would do is discourage people like Bradshaws from taking action as blithely as they have done in this instance.

    I will contest this as I really see no option but to do so.

    Apart from which I notice that our friends at Bradshaws have seen fit to add on £192.54 in interest charges as well as £80 solicitors fees and £120 court fees. I should imagine that anyone owed money by them adding likewise would be told where to go.

    They also sent the documents to the wrong address, it went to my own home which is not the registered office of the company nor has it ever been, or mentioned on any documentation. So where they got it is something of a mystery and I will endeavour to find that out, but if I find that they’ve been snooping on my personal life I will not be a happy bunny I can assure you. I actually find this quite offensive.

    And you are correct Richard, it’s simply a case of the big boys trying to bully the little guys about again, nothing new and it won’t be the last time it happens to one of us either I expect.

    Yes Alex, I’ve mailed Tony Challice to see what he has to say as I really don’t want this to get ugly, I never did, hence my previous offer to Bradshaws. However it appears that they do not wish to accept the easy option.

    Yeah Tony and if it has an anti-flood fill hose check that too as we’ve had a few on Smeg that have been a problem of late, at £65 a throw! 😕

    Yeah well since I hadn’t been notified, as I was promised would happen, I had no paperwork or anything to hand and there was no way it was leaving without some form of paperwork or proof that it had been collected. Made even worse by the fact that I was walking out the door late as it was when the guy appeared.

    It just seems to me that Bradshaws are very keen to take me to court over this and not very keen to resolve the matter amicably. This is despite my offer to just call it quits even although it would end up in a situation where they would owe me money, which I thought was more than reasonable.

    Yes Kev I am a DASA member but DASA has no system in place to deal with such matters and, when the subject has been broached on previous occasions although admittedly with the previous director, no appettite to take up such matters on behalf of its members. This is one of the areas that I feel DASA should be addressing.

    I shall of course be seeking further legal advice before proceeding.

    However, in the meantime, just to show all what sort of company Bradshaws is and how they deal with any disputes here’s a PDF of the latest round of faxes that I sent to Dave recently to review. I have nothing to hide.

    Needless to say the spares that were all supplied either incorrectly or double and even triple orders sent in erro are still here and the invoice sent to Bradshaws remains unpaid. And yet they see fit to take me to court for unpaid spares supplied in error BY THEM!

    No not really, but it seems to be a fairly common occurence as I’ve seen or heard of it a fair bit after a power cut. I suspect that if the compressor was already a bit iffy then this is just enough to pop it. 😕

    Yes, that’s how it was originally setup, all the other methods were added through time just for ease really. The thought being that £5 a month was really and insubstantial amount to most people.

    Normally that is indicative of a goosed compressor, which is not good news. But can you give us some more info, like the model number and approx. age of the unit?

    You have to admire the old bald one’s way with words don’t you? 😉

    But, whilst blunt, he’s totally correct! There are over 12,000-15,000 unique visitors to the site every month and the vast majority of those find it as they have a problem that needs solving.

    What you have to ask yourself is, how many of those 12,000 a month are in your areas and are, potentially, your customer?

    Yes, agreed Kev, but the thinking is what has to change or else we will end up with no trade, it really is that simple. It’s obvious to a deaf blind man that the traditional approaches to service just aren’t working to a large extent and the problems are growing as time passes. The question is, at what point are manufacturers et all going to actually do something about it?
