I have to say K that I am a little disappointed that you did not admit that this article was written in a fit of pique and that you dismiss so off handedly constructive criticisms from Martin. This thread is not just for those who do warranty work, as we all get asked for our advice on a daily basis and being honest with the customer is to my mind of paramount importance without as Martin says giving too much away.
The article itself bears very little resemblance to the actual sale of goods act; in fact I would go as far as to say it is totally misleading with regards to the customer’s rights. Any old dear reading that would more than likely just give up pursuing a legitimate claim. There is nothing pointing them towards factual info on the subject just the word according to K, no reference to the CAB or trading standards or the act itself.
Neither do you say that by accepting a repair it undermines any future claims, I really do believe that this article was in itself a very good idea but maybe due to your obvious bias you should have thrown it open to see if someone wanted to do an informative unbiased article that would have been welcomed by all, you speak of truths but what I see is your opinions and we must never get the two mixed up for everyone’s sake

Now now Mr Penguin sir don’t get you feathers ruffled over a few less than amusing digs (that rs is a swine) I am sure you handled yourself with complete decorum in very difficult circumstances, acting like the true hero that you are to save the poor customer from extensive water damage to his property, you sir are a credit to us all and in sharing this mishap with us you have done us all a favour in reminding us of the dangers these hidden Y pieces presents.
I have been reading your posts over the last few weeks since I joined UKW and I realised what a clever bird you are, a veritable font of knowledge and experience and I decided to try and emulate you so I am growing a beard and walking with my feet at odd angles and watching Mary Popins to try and get the movements right.
I have put a washer in the back garden to practice diving over with pliers and screwdriver (haven’t figured out what the screwdriver was for yet?) but I’m not wetting any sockets till I get it down pat. 😯

To be serious it is always a pleasure to see someone get totally immersed in his job and as we live so close together I was thinking we could start a job pool so we could get more done and avoid the bail-iffs at the door. I know it would be a case of sink or swim for a while but I think we should bite the bullet and dive in. Give it some thought and let me know. Don’t let this idea leak out other may want to join and then we would be swamped out.

I am writing to complain about the poor standard of workmanship I received in relation to the above job. As evidence of this I enclose a list of the problems. The work was clearly not carried out with reasonable care and skill (as required by section 13 Supply of Goods and Services Act) and, as such, amounts to a breach of contract. My poor cupboard will never be the same again and when I switch my cooker on I get radio 3 and my decorations are ruined the paper on the floor will need to be replaced and there is clean marks where you wet feet were.
Unless and until, these matters are rectified, I shall be withholding the balance of the contract price. Furthermore, if you do not put matters right within two weeks (or such other period as we may agree) I shall get another contractor to do it.
I will obtain a few quotations from reputable contractors and if the cost of the cheapest exceeds the balance of the contract price, I shall claim the extra from you by way of damages.
I will also report the matter to the UK Whitegoods Association, of which I note you are a member.
I await hearing from you.

ParticipantThis is yet another sad case of an individual being intimidated and bullied by a company who try to move the goalposts at every opportunity to force you to comply with their way of doing things, regardless of what you originally agreed upon. I find this type of behaviour completely unacceptable and the quicker this company goes under the better.
I find that I have to agree with Kevin that this has to be looked at in an unemotional way, because that is how the law looks at it, they are only interested if facts and what can be proved. But having said that, what then becomes of our principles if we just give way because it may cost too much even when we know that we are in the right? It is my belief that sticking to your principles is what makes you a success, it is why people recommend you and come back year after year, and your integrity and principles are really all you have got and if you let one walk all over you it just encourages others to do the same.
In my opinion K has no option but to fight this all the way as his integrity has been questioned! After reading the PDF he kindly put up here it was obvious that he was not dealing with any sane person but one who has been given too much authority and is acting like a petulant child who can’t get their own way, failing to deal with the real issues and constantly repeating themselves.
May be it is time to consider starting a ring fenced fund to defend issues like these and to enable the boot to be on the other foot at times.(maybe you should do a poll K to see what the interest would be in this?) K said he was willing to write off what they owed him and put it down to experience, but why should he! He worked for it and monies owing should be paid.
Perhaps we should have a whip round i.e. we all get a whip and go round there.

Sorry Martin but I stick to my statement; I don’t doubt Brian’s good intent or integrity but I do doubt the company he works for. No disrespect but I do have experience of dealing with things like this in other areas and I got burned so many times wanting to believe the promises that were made. So unless Brian is in a position to issue the orders and actually make it happen my view will stay the same, time alone will tell.
I cannot be bought off by feeble promises or a handful of goodies, I am not as eloquent as you or Ken when it comes to putting into words what I truly feel and I have seen this going on for so many years; you can only negotiate a fair deal from a position power and I’m sorry to say in this area you are lacking the requisite means to do this.
Bit of a sad story this, being repeated again and again! Yet you go on trying to find the peaceful solution to the problem which in itself is very laudable. Communication is the most important thing in situations like this but it needs to a two way street. I have said before in other posts that the manufacturers make more out of selling parts than they do out of selling the whole unit so why would they want to change this? They are not charities and they have shareholders to consider, their aim is to make as much as possible from every available source including you.
If you doubt me just ask the members of this site to post who they are working for and how much they are paid per job, I would bet that when they compare notes there would be many phone calls made about rate differences around the country.
I have read recently of “exciting” things in the pipeline, how “beneficial” to all the recent discussions have been. Now call me cynical if you like but I will bet that in twelve months time very little will have changed and you will still be disgruntled and they will smile and make placating noises next time you have “discussions” and still they win.
So what is the answer? How can you be sure you are not been led down the garden path once again? You can’t; what you could do if you were together on these issues is really negotiate a working relationship with these people, but as you are and will remain, you have no chance. The one organisation that purports to represent our trade in fact represents less than 10 {e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} of independent repairers, and without the support of at least 50{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} they are powerless to negotiate any kind of deal that would be of any lasting benefit. I am sure that they would try to include everyone but there will be dissenters who, because you are not member will not want to share the benefits gained with their membership fee and I don’t really blame them it’s not particularly cheap.
There are some good dedicated people out there doing their best to try and improve things for this trade and there are those who will only join together if it were to personally benefit them financially, or call them what they are freeloaders, let others do the work so they can reap the benefits.

I had read the news on the front page but to me it said nothing at all about how DASA intends to attract new members, how the benefit of membership would outweigh the membership fee, or how it intends to keep the membership it already has.
The comments on the original post were from the members and non members, I don’t doubt that your meeting was interesting with regard to your guest speakers and such but have things changed enough that the original posters have altered their views? Has some kind of peace been sorted out in other words I was after the personal views not the official ones.
