ParticipantRe: Advice required please.
anyway;
question; who would you ake advice from, yourself or a solicitor with years experience;
answer; i would make my own decision, so it is my own and not my solicitors.
i have had to do this in the past; an example; my divorce solicitor said offer the ex £1000
i told her i didnt want to do this and hey presto; i didnt have to pay 1p at the end of the judges decision.
so, i use my own head, ok, i will listen to what others say such as solicitors, but i will make up my own mind what to do
hope that has answered your question in your last post

it would be helpfull for the original poster to make some comments.
ie such as update with the situationme personally, if i had to wait week after week for late wages, wouldnt stand for it.
id rather “stay in bed” then pay for bus fare to work my socks off for nothing.

ps i have tried my best from my knowledge to help the original poster, because as everyone knows, its not nice not to get paid.
also for the readers info, may i highlight, because i have been to court on many occasions, does not mean that you are wrong.
definition of a law court, where an argument/settlement/dissagreement etc is resolved, in a controled enviroment where disscussions can be held.
yes i have been arrested.
for the bods who havent lived;
case accused of; assulting a pc in the executiion of his duty
outcome; not guilty.

hi, yes i do like talking to myself, im a shcitzophrenic.
ok, firstly;
i am only posting to try and help,
i am talking from experience.
i have appeared in court on many occasions for many reasons for various cases.
when you are in court, there are two sides.
solicitors argue with each other representing their clients.
they cant both be right, ok
it is upto the judge to make the decision, or the juryin alot of my cases i gone agains my solicitors advice and come on top, better than i would of if i took my solicitors advice.
solicitors are out to make money….end of story. (apprx £100 per hour plus costs and expenses)
it appears that you are cleverer than me, why have a go at me when you being so clever could of wrote something constructive to help the original poster?
ps my replies on here are because i am not sneaky, or i dont hide things. i am honest and upfront, simple.
ps; how do you know a solicitor is lying?
……he moves his lips.torxhead

i have been sent a pm by iadom to warn me not to cross jackal, lol
i understand he is affraid to post so everyone can see what he has said.
i spoke my mind on the forum of factual experience.
if no one likes what i say, tough.
i have no way been abusive, offensive, or insulting to anyone.
rather an indepth discussion which i hope has been construcive and helpful to the post, however, it appears to me that some folk out there just cannot deal with it or hack it.

hi jackal, yes, i found myself in a situation.
i havent worked for an employer for 20 years, being previously self emplyed.
seeing the job advertised at the jobcentre and the actual jobcentre arranging it for me, made me assume things would be cosha.
the job wasnt offered to me by the geezer in the pub, but by the geezers in the jobcentre.
same thing really, cos it was the same attitude when i returned to the jobcentre and told them i didnt get paid.what difference has it made? whether i got the job from the geezer at the pub or from the geezer at the jobcentre?
what they both have in common is that they both get paid and dont give a s**t.in fact, its better to do the job for the geezer in te pub, cos unlike the jobcentre, you can get paid upfront !!

jackal, would you work for nothing? i wouldnt.
also, in this case, waiting 12 days for a wage, she got it, i doubt the tribunal would act on a late payment.
simply its upto the employee to take it up with the employer, face to face and simply tell them if im a day late in receiving my wage, i wont come into work, simple.
no money, no work.there must be no communication between the emplyee and employer in this case?
a tribunal will ask have you approached the employer before coming to us? well er NO.
if you cant speak to your employer about these issues, or any other issues you are not happy with, then er, whats the point?
it is annoying not to get paid when you should, but by continuing working is proof that you dont object to lat payment.
what more can i say, or what more can anyone else say about it?
if i dont get paid off a customer, i dont go to a solicitor or court, i simply approach the customer, they are the one who can do something about it, you wont get yyour wage off a solicitor, all he will do is want money from you.
c.a.b do not give the best advice, they give the right advice.
try asking the c.a.b what they can actually do about it, when you visit them, you will still not be any more satisfied.
i worked for the c.a.b. for a short while, and i was told you do not tell the customer the best thing to do, you simply record their details and it goes on to a lrage datablase. thats it !

if you dont have anything in writing from the employer, how can you proove you even work there? such as a contract.
i have mainly worked self employed, but when i worked as a security officer, the agreement of my hours, dates, and wage were verbal.
another instance, i worked for a firm for 2 weeks, given the job by the jobcentre, and i didnt receive on penny wage.
i gone back to the jobcentre, throught all the channels, and they told me there is nothing i could do.
all they could do is give me benefit for the 2 weeks i worked.
i was more satisfied doing it my way, tit for tat, with the first employer i worte about in my previous post.
i got more satisfaction handling it myself (being independent as i am) than relying on the jobcentre or any tribunals or county courts.
the employer who didn pay me at all, denied i even worked for him, what proof could i provide? nothing, there was no contract, only a verbal agreement. i was told this by a jusge at the county court.

ParticipantRe: customer wont pay
put it down to exeprience.
regaring the bearing job, you mustnt of done it properly.
i have learned i now change the spider shaft when i do bearnings. that way is doing the full job and not half a job.
i enquired once at the county court, and tbh, to do it properly you should have a sgined contract before you start any work, thats how the courts see it. for ou to get a seccessfull claim
saying this, in reality, most genuine cutomers will be offended and put off your services if you get each and every one to sign a contract.
use your skills and experience and explain to the customer beforehand if they may have to pay out any more money in the near future on the same machine, thats all they want to know really.

ParticipantRe: Bit of advice..
from a laymans point of view;
you received the part and signed for it, assuming it was in satisfsctory consdition
it has been established now where the part was from
it has been established the part hasnt been paid for.
they delivered within their time limit? yes.
if i were the online firm, i would incuur late payment charges. and they are quite within their rights to do so.
i would suggest you pay them immediately
