    Martin what you have said is fair enough, firstly the reason I was asking in two threads was due to the fact that no one had offered any opinion in the first so I decided to widen the question in the General Forum.

    I would comment as follows on the points you have raised.

    1. Most companies especially those that have trading outlets have invoices with their Terms & Conditions published on the reverse and that was before BERR was ever thought of !

    2. By having published T & Cs customers are aware of how you operate your business and in the event of a problem the procedures which will apply.

    3. As long as the terms and conditons are legal and NOT restrictive to the statutory rights of the customer then they would stand in court or with the Trading Standards people.

    4. I am not trying to complicate my business or confuse my customers merely to bring about how we operate into clarity.

    Even when my local ariel installer came round last week to fit a new rooftop ariel his invoices had T & Cs written, my local garage has them,
    Recently when I had a problem my solicitor was surprised that we did not have T & Cs on our invoices and suggested that we remedy that situation.
    So before I dug any deeper into this I thought that I would ask the question here on UKWG to firstly see if amyone had already done the donkey work of the wording and secondly to gauge the general opinion.

    This has been an ongoing issue for some time, the more accounts using the site has ground the thing to a halt. They need to sort out that site it is running pearl script hardly used in any modern site now and bandwidth must be a issue as well.

    I had concerns when thay axed the DVD earlier this year without much notice and now that its webased its vital that it works properly, especially as I now want to access that site when I am out on the road via mobile internet.

    Pensions like Endowments are long term plans but as we all know they are only as good as the markets in which the funds are invested. The fac is the markets have been bad for a long period not just during this credit crunch and we have had long term low interest rates all of which are bad for pensions and endowments hence the depressing figures being quoted.

    Most of the folks I know who have pensions are now saying that they wished they had never started them as they will be almost worthless ! and they wish they had invested the money in other things. Still Labours motto is Things can only get better ! so are we to believe them ?

    The alternate number they are offering is a local code dial number which would not put people off, I agree about the comments about the book versus the electronic lookup though

    Well There may be new models on the brink of release but Acer are running serious TV advertising on the Acer Aspire One which makes me think that it is the current NetBook Contender at least until the new year and don’t forget that the Aspire One has a 8.9″ LCD screen already ! which is far better than the Asus EE range, but not as good as the HP netbook.

    As I already have a Acer Aspire 15.4 laptop I wanted something smaller and once you get back up to 12″ and 13″ screens then your almost back where you started !

    While we are talking about Netbooks a lot of people will want to get then running on the net. I have just had a nasty experience with mobile broadband, I decided to get onto the 3 network with a mobile broadband modem which had a 5 GB monthly allowance with promsied speeds of at least 2.8mps probably 3.8mps.

    Well anyone thinking of going with 3 be very careful ! I got mine from PC World and after two days took it back and cancelled the contract.

    The speed WHEN working was ver————-y slow, most of the time there was no network available and the Tech Support at 3 stated that I was is a very good siganl area with their turbo speeds available at 7.8mps !

    What a joke ! the support at 3 is rank, if you like calling India on a regular basis on a 0870 number then 3 is the way to go, couple this with all the Bullsh** that the people at PC World try a give you its a complete disaster which they expect you to pay for !

    Because all I want to do is access Connect,other spares services, my own server, and send a few emails I have got my phone company T Mobile to upgrade my account with web and walk which is ruuning on the netbook via bluetooth using my phone as GRPS modem.

    The upshot of this is that I am getting between 112kps and 120kps connection speeds like dial up but a bit quicker, far quicker than 3’s turbo mobile broadband, there is no contract so you can finish when you like as opposed to being locked to a long contract, youncan connect almost anywhere there is a phone signal, and you get 3Gig per month all for
    £12.00 inc Vat.

    I will be using this system until they get mobile broadband sorted out and by then the prices would have gone down.

    I use a miners helmet which is so very useful ! Not only does it keep the light right on where you are working but the other week I had a angry customer who treid to hit me over the head with a frying pan, needless to say that helmet took the blow and I was ok !

    I am now thinking of getting a Pit Pony to cut down on my motor running costs !

    If these alligations have been made by the ex employer and you know that there is no substance to them then he has commited Comercial Slander of your good name. Things like Expensive legal proceedings come to mind but lets think a minute ?

    Have these alligations been made verbally or have they written the alligation down in a work report or letter to the client ?

    I would firstly establish this and then write to the ex employer asking him to rectract his comments in writting. If he does not then I know that to pursue slander is a horrendously expensive journey to travel and what you really need to consider is this, is the work that you have lossed that valuable to fight such a battle ? if not then we are looking at the fact that your pride and principles have been infringed and dented and you then have to access the cost of that and if it would be worth fighting for ?

    Personally I have myself just encountered a bad experience where I have been slandered by someone and Yes I am so upset by it, but I am of the view as is my solicitor that it would not be worth the costs involved to trawl through the courts to try and win a judgement and I have to accept that as being sound logical legal advise.

    There are companies that offer to undertake such cases on a no win no fee basis but you would need to really investigate that avenue if you have a mind to. As a last note do Corgi not operate a internal scheme where when a registered members work is called into question by another member that Corgi investigate the matter.

    I dont do Gas but is it not the case that its down to the last man on the job ? Three engineers have worked on that installation after you and more the point what evidence does your ex employer have that the faults he describes are attributable to you ?

    I would also be making enquires that if indeed you were responsible for any error how is it that none of the other corgi registered engineers noted it and either rectified the issues or actually rememdied them ?

    I would say that your ex employer has no idea who was responsible for the issues, how could he have ?

    What if there had been a Gas explosion ? surely any investigation would center on who was working on the installation last and that was’nt you was it

    Thanks Martin I agree entirely about naming and shaming such customers in the context of a website like this, that said we all need to be vigilant of such people and we acted in good faith with this customer throughout the process. Had there have been any inkling that there could be a problem or any vibe from them then we would have walked away.
    As it stands I am comfortable with my legal position and have no concerns of issuig the necesarry litigation to deal with this matter, In fact I welcome our day in court with this customer as at the very least it will provide me with a days entertainment at their expense !

    The customer has now been served with a Legal letter and we will await further developments in that department, They have played there worst hand and I am sure that this will reflect very badly on them when the day of judgement arrives, as for being done up like a kipper they may well find that they end up being the kippers !

    Mac its not often I harbour unhealthy thoughts but events such as this do make you angry that here we all are sitting ducks waiting for that 99.9{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} chance to occur where us the poor engineer is set up by a customer who has decided they dont wish to pay. This poor excuse for a humanbeing obviously sat and premeditated this engineered this plan to try and avoid payment in the process calling into question the integrity of the engineer and placing him into the position of being carted off and subjected to DNA testing, Fingerprints being Taken along with hours of questioning not to mention then not being able to proceed with his work and the truama to the company with the logistics of it all.

    In this particular case the appliance had been re-installed in the property and the Engineer would have had to re-enter the premises to try and get the appliaance back out, the charges then may have well had breaking and entering added, who know’s ?

    Yes we have had a significant number of pattern elements ( Neff ) fail within a very short time and Connect have supplied them !

    We are now sourcing them from elsewhere to see how we go
