I get phone call this afternoon from D.P. and during the conversation he asks if all is well? Dangerous move that one. Any way, I tell him the H.O.A. is unworkable in the present form etc. He then tells me he’s had an e-mail from Ken. He chuckles without divulging too much content, but goes on to say “Looks like he has learnt a lesson, and there has been some chat on UKW” I tell him I haven’t seen any such chat, but expressed my surprise that it hasnāt hit the headlines yet.
Of course we have not said a word on this YET. Like the little veiled pop in another thread though.

There is a lot of traffic on the Repaircare website forum, and there are quite a few that said they will NOT sign as is.
My posting from yesterday….
Section 18 seriously needs to be addressed.
Repair-care should have insurance cover in such an eventuality? Meaning, when they take on a new contract, it is Repair-care who is assessing the risk and then I assume on this heads of agreement we are expected to take this work based upon their judgement, and we have no say in the account. We as the repairers are not in a position to evaluate the credibility of any new contract, and therefore should not be expected to undertake the risk.
So, if Brandt for example goes pear shaped, we would get the double whammy of parts as fitted being contraād straight off our purchase ledger, and stand a poor chance of being paid, and the parts are at Connect prices. Any possible failings should be factored into the negotiations of any new contract, not left for a small family business to take the hit. I am a victim of MFI and involved in a legal battle regards offset and amounts due on the account.
The following still needs looking at, but not as important to me as section 18.
Section 2: All calls to be accepted. We do NOT repair makes that are not in our service skills etc. That includes pressure washers, vacuum cleaners and several makes such as Meile, Hotpoint etc. We are finding we decline chargeable calls only to find them come back as “Repair-care chargeableā.
Section 24: My vehicles are already liveried as Service Force, any other labelling will dilute the image, and the van would look like a suitcase. Considering 80{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} of Repair-care work is on S/F related products, then Iāll leave as is.
Section 25: Work-wear, makes sense as Jeans & trainers are a not good. We already have uniforms that we paid for. Further dedicated work-wear impractical, means engineers getting changed in phone boxes and we have not got uniforms in red & blue lycra yet.

Not my cup of tea was Jacko, but the media summed up nicely as “A Song & Dance Man! He was innovative, and I suppose clever, but there are many more out there.
My mobile has not stopped today regards text messages. However I won’t recall in several years I remember where I was when it was announced. unlike Lennon etc.

I usually create a criteria based on some key words from message rules on outlook express.
For example if message contains the words Spam, Nude, Viagra, Calais (or whatever it is called) I have them set as delete from server.

Hi Jackal.
I agree with your first line, it is up to them to prove it, not me Disprove it. After seeing the letters where the cases have been dropped, and it has been admitted there was an IT issue regards MFI due to non payment; such matters will help my resolve towards strengthening my case.
I have been asked by Sovereign on the phone to send ALL hard copies, and I know if I do I shall be making my own bullets. I have made that point to Zolfo Cooper as well. Naturally they will stay in my brief-case until I’m instructed by the judicial system as case support documents

I received my first letter a week after everyone else, and was on holiday in Jersey. First proper holiday for 3 years. By the time I got back and wrote my epistle to those concerned they had taken further legal advice, my letters were posted the weekend of May 17th. I guess those like me who got in later not so lucky so now they can screw the rest of us down.
Zolfo Cooper told me on Friday they realised they had made an “error” regards the complexities with off-set, and those who has been “let off” were the lucky ones. They went on to say Sovereign can only take cases to court after seeking their permission on an individual basis, and anyone like me in this position will NOT be given notice from either party. There is no arbitration system between Zolfo Cooper & Sovereign, they (Sovereign) are instructed to collect all monies outstanding.
Zolfo Cooper said if I send copies of ALL invoices in dispute to Sovereign, the amount can be reviewed rather than seeking the sum in full as on their books. All very well, but then my case may be reduced because they cannot prove the figure they are demanding at present, however once I give them the documentation they have the evidence they need. So I could be instrumental in assisting their case.
Now I’m in a quandry, either brazen it out and fight against the incorrect figure they are demanding, possibly lose and get stung for the lot. Or supply them the correct details, and be prepared to pay out on the correct sum which is 50{e5d1b7155a01ef1f3b9c9968eaba33524ee81600d00d4be2b4d93ac2e58cec2d} less.

Just had a letter from Zolfo Cooper.
They are having none of it, they tell me the debt has been passed to Sovereign, and the only chance of off-set will only be considered regard transactions carried out after Oct 16th. They go on to say Soveriegn has been authorised to take whatever action appropriate to collect payment in full.
I put in my letter there has been some companies where the “Debt” has been cancelled (No names mentioned) However, they ignored that point.
Looks like I have a fight on my hands.

Well done you guys that have had the matter dropped.
Despite some of you MFI agents getting a letter advising the matter is closed, I have had a final demand from Sovereign and 7 days to pay.
All my correspondence to Soveriegn & Zolfo Cooper, sent recorded, has been ignored, and messages left have not been responded to.
Is it a case that I’m the only one or are there others that are still showing as a debtor?

I had to a 5 Year apprenticeship to become a fully indentured electrician to City & Guilds final C certificate. August 1965 to June 1970
So I spent all of that time on a very small training wage, block release courses, and one day per week until 8 pm. Used to have to take the train home, last train went at 7:50 pm and it was a 2 mile walk to the station from the Tech College, I used to have to beg every week to be allowed to go 30 mins early.
Has the job got that much easier?

allyWe used to get that when we were Baumatic agents, and still do when the call comes via Repair/Care.
We phone the customer, and if there is a hint of issues or history, we bung it back to Repaircare. Most calls we get are where the B/Matic eng failed to show, then we are faced with an angry customer.

ParticipantRe: contract work vanished
Everything has dropped slightly. Normally half term all hell breaks loose.
Connect/Repaircare down, Electrolux I/G work down, even D&G work down. Seems to be general, except chargeable which is about the same.
Guess short term and not worried as yet, this time of year is always quiet. At the moment it is nice to slow it down, but the bills still keep on coming.

Out of intrigue, you guys who have received a letter advising this is being dropped. Who did you contact or write to? I sent a letter to Sovereign, and have heard nothing to date.
I guess everyone had their letters from Zolfo Cooper?
