You don’t need to talk to anyone one to one, paying the guys on here what you owe and on time will say everything that needs to be said, sadly you appear to want to remain mute in that regard.

I have documentary proof from the customer concerned that they paid you up front and a tape recording of our telephone conversation, Daniel where you confirmed it.

Having had a very long relationship with Comet since the 1990’s, I know them very very well indeed and to say I was surprised at the comments alluded to by Go Local with regards to undertaking work on their behalf would be a massive understatement.
The evasion of the questions asked placed more than a little suspicion on the claims being made in my opinion. I have spoken to at least one Comet Director whom advised he has no knowledge of Go Local whatsoever, this is from someone directly involved in Service.
Now over the past couple of weeks at least 6 members have approached me for advise on how to obtain payment for work done, some of which is now 6 months old. Having totalled this little lot up it’s over £4k and that’s just the ones I know about.
One company took my advise and has recently successfully obtained a County Court Judgement and over the next few weeks will issue proceedings to petition to wind up Go Local Reactive Limited. Having obtained the CCJ it is easy and straight forward to do now.
As no accounts exist for Go Local Reactive Limited, and by their own admission they set up less than a year ago with just £200 capital to their name.
Given this I cannot see how Comet would ever pass work of any description to them, also when Comet needed help getting themselves out of the doodar they went to Repaircare, you know Repaircare whom are one of biggest established fixed cost cash work providers in the UK; wouldn’t you expect them to sweeten the deal with that work as well as the stuff we know they gave them?
Having been bitten once by Go Local I know from experience how they work, that’s take the payment off the customer first of which a portion of it is to cover the agents labour cost. So if they have the money up front why are so many agents complaining about non payment?
I have to ask, why so many address changes, why so many complaints of non payment, why evade court summonses, where is the money the agents have earn’t going?
In my humble opinion this is going to end in tears for everyone whom gets involved with them.
I am sorry to say but when it looks dodgy, smells dodgy and tastes dodgy, then it’s usually dodgy, and that’s my feeling on this one.

You should visually check the fan oven element for cracks and splits or check the resistance of the fan oven element for continuity. If it is cracked or split or not registering continuity then it’s failed.
Visual checks are done through the front cavity having removed the back panel. Continuity checks are done via the back with the rear cabinet panel removed.
In all cases isolate the unit from the mains!!!!

He needs to prove the goods were of unmerchantable quality and not fit for purpose at the point of sale, assuming he bought them face to face with you, not via a mail order system.
He will also need to prove he was competent to fit them and that no other faults with his appliance caused the fault to appear in this part.
In short given you posts tell him to go forth!

The T&Cs used by ISE were designed to deal with a primary retail scenario with a provision for a repair facility as an add on.
I have a set which relate to repair only operations which are 1 A4 page long and are designed to be printed on the reverse of a job card.
We have the professionally printed so when our engineers call they load them into their printer and print a job sheet with them on the back.
I am out of my office for the rest of the week but I will forward the to Ken over the weekend so he can put them up here so you and others can download them and edit the name so they are relevant to you business.
I would do it myself but I haven’t got the first idea on how to load it up here.
Unfortunately the necessary clauses make reference to other sections of the T&Cs so unless you know how to reword it all it won’t make sense, so just leaving this section with the cust won’t help much on its own. For example in the above clause it makes reference to another clause known as Section 5.
For me section 5 details how and when payment is to be made thus it enables action to be taken if you are not paid within the stipulated time frame otherwise you can get strung out for god knows how long waiting for payment or the rejection notice.

Hi all
If you do regular work for a letting agent or similar such as work provider, you should send a copy of the T&C’s to them before you do the work, say by email or better still by recorded delivery post. If afterwards then instruct you to do work, then your T&C’s are considered valid and binding on them as in the eyes of the law that they have agreed to them by sending the work to you. You should send them periodically, copies of your T&C’s, certainly once every 12 months.
Then when you then go to the property address, i.e. the tenant, or the WP’s customer, you get them (tenant or work provider) to sign your job sheet which includes your T&C’s on the reverse.
LEAVE a copy of your job sheet or T&C’s with the Tenant/Customer so they have a copy of the Contract they have just agreed to. You will need to retain the signed original copy but the tenant/customer only needs a copy of the T&C’s, that copy does not need to be signed.
My engineers print the job sheets off a laptop with a portable inkjet printer so we print everything in duplicate and the customer gets a copy; it is just as easy to use a duplicate pad if you wish or even just have your T&C’s printed on A4 and leave a set with the customer.
In doing this what you have just created is a joint and several liability contract for the cost of the repair, which in effect makes the tenant/customer equally liable for the cost of the repair as well as the Letting Agent/Work Provider.
So if the Letting Agent/Landlord or Work Provider fail to pay up or reject your invoice for whatever reason, you now have the ability to pursue the tenant/customer.

One must remember the CURRENT constitution allows for associate members already AND it allows for those associates to vote and join the Management Team.
The new constitution is designed to remove those anomalies by formally defining what are considered associate members and what they are allowed to do.
This I think benefits members whom have a desire to retain the independent status of the Association.
Of course how you sell it to the members is up to you but I think they should be aware this particular change is designed to both allow associate members but restrict their undertakings.
