ParticipantRe: Grumpy ( but highly successful ) Scot retires.
he was involved in a lot of local clubs to this area including our local juniors where he would come along and watch .. had a great friendship with ruby connel (a local legend) at Bonnybridge juniors he mentions ruby in his biography would often visit the Connel family at their farm in Bonnybridge , i know this as my father inlaw was involved with the juniors and met him a few times ..
heres at bit about him …he was a busy man before his legend status ..
He managed the Scotland national football team for a brief period in 1986 before he moved to the Aberdeen Football Club.
Between 1957 and 1974, Sir Alex Ferguson spent his playing career with the Queen’s Park FC (1957-60), St. Johnstone FC (1960-64), Dunfermline Athletic FC (1964-67), Rangers FC (1967-69), Falkirk FC (1969-73) and Ayr United FC (1973-74). Being a talented striker, he helped the Saints’ to win the Scottish First Division in 1962-63 and the Bairns to secure the Scottish First Division in 1969-70. By the end of the 1973-74 season, Sir Alex Ferguson completed his stint as a player scoring 167 goals in 327 appearances that he made for various clubs.
(when at falkirk he was in a team that again very little known about this – the team were going to strike which would have sent a few shock waves out ..)
At the age of 32, Sir Alex Ferguson began his management career as a part-time job in June 1974 with the East Stirlingshire FC. It was only when he moved to the St.Mirren FC, that he started his full-time management career. With him as the coach, the Saints’ team won the Scottish First Division in 1976-77. During his stay at St.Mirren, Sir Alex Ferguson coached the team and spotted young talents like Billy Stark, Tony Fitzpatrick, Lex Richardson, Frank McGarvey, Bobby Reid and Peter Weir.
In June 1978, when he joined the Aberdeen Football Club (FC)

ParticipantRe: advice required
ok re edited and spell checked , i have passed the info onto insu co who are not sure if they will take this on ??
this is my reply to lawyer – not sent yet if anyone thinks i should reply differently please advise
With regards to your recent correspondence dated 03/05/13 we have passed the details of this case to our insurers who will be in touch
I can however advise that the area where the bins were left for collection was clear of ice and snow and was gritted by the janitor of the office block , we can supply witness to this if required .
This clear and gritted area was not where your client slipped .
As you have stated you fail to see the relevance We have in the meantime requested you clients health and safety ,training , ppe policy direct from his employers ..
to insu co – a map of property showing where bins were , where lorry parked and the route the collector took.
will also give them this covering letter – i was going to send this back to lawyer but will now sent to insu co. again if anyone can suggest a better script please do so
the car park is the size of a football field , we rent an office within the property , there are another 12 offices and 10 workshops who share the same car park , we are not responsible for the maintenance of this car park and would not have been able to grit or clear this before the bin collection lorry arrived at 11am
However the area around the front of the office building including vehicle access ,doorway and walkway into office main entrance was clear and had been gritted . ( we can supply witnesses to verify this ).the bins were situated in this area ,from a health and safety point of view the bins were left in a safe and suitable area
the lorry did not park at the vehicle access area it parked over 30 feet from the bins , in an area of the main car park where the ground was icy
the driver did not follow company’s h&s policy with regards to risk accessing the work area and should have instructed your client not to leave the vehicle ,your client had to walk over 30 – 40 feet of snow/ice to get to the bins this should have alerted him that the distance and work area have been effected by adverse weather conditions and would have not been suitable to move a half ton bucket back over 30-40 feet to get back to the lorry
your client clearly had ample opportunity to risk access the adverse conditions and should have followed the health and safety procedures of his company
re your statement that you fail to see the relevance in our request to see your clients h&s and ppe procedures
this statement seems extremely odd taking into account that if your client had followed health and safety regarding working in adverse weather he would not have hurt himself
re statement that the the responsibility for the safety of visitors to the premises rest with occupier namely ats ,
we are not the only occupier there over 20 other business within the property and share the car – we cannot be held liable to grit a communal car park and would not have been able to do so by the time the bin collection lorry arrived at the premises, again it would have been plainly obvious to the bin lorry driver and your client that their work area was unsafe at this point they should have followed their h&s policy
we cannot be held responsible their failure to risk access their work environment with regard to adverse weather condition

this is reply i have drafted so far , probaly a bit naff so if anyone could pimp it up that would be great ..
sorry for cap lock , didnt notice they were on when i was drafting letter ..dohhh
im not planning on sending this its just rough draft to get started ..
THE CARPARK IS THE SIZE OF A FOOTBALL FIELD , WE RENT AN OFFICE WITHIN THE PROPERTY , THERE ARE ANOTHER 12 OFFICES AND 10 WORKSHOPS WHO SHARE THE SAME CARPARK , AS SAID WE ARE NOT RESPONISBLE FOR THE CAR PARK ,
THE AREA WHERE THE BINS WERE SITUATED WAS PERFECTLY CLEAR WITH NO ICE OR SNOW ON THE GROUND, AS FAR AS WERE CONCERENED THEY WERE LEFT IN A AREA WHICH WOULD NOT CAUSE ANY PROBLEMS
HOWEVER THE LORRY DID NOT PARK AT THE CLEAR AREA IT PARKED OVER 30 FEET FROM THE BINS , YOUR CLIENT HAD TO WALK OVER 30 FEET TO GET TO THE BINS ,WHILST WALKING THE 30 FEET TO THE BINS HE SHOULD HAVE REALISED IT WAS NOT SAFE TO ATTEMPT TO PUSH A HALF TON BUCKET BACK OVER 30 FEET OF SNOW AND ICE TO GET TO THE LORRY HE OR HIS CO DRIVERSHOULD HAVE RISKED ACCESSED THE SITUATION BUT OVIOUSLY FAILED TO DO SO
TO RISK ACCESS THE SITUATION , HE OVIOULSY FELT IT WAS SAFE TO CARRY OUT HIS DUTIES ,
WE CANNOT BE HELD RESPONIBLE FOR HIS FAILURE TO RISK ACCESS HIS WORK INVIORNMENT
RE YOUR STATEMENT THAT YOU FAIL TO SEE THE RELEVANCE IN OUR REQUEST TO SEE YOUR CLIENTS H&S PROCEDURES
SURELY YOU MUST SEE THE RELEVANCE THAT WE WOULD LIKE PROOF YOU CLIENT HAS HAD ADEQUATE H&S AND THAT HE ALSO HAD APPROPIATE PPE ISSUED FOR ADVERSE WEATHER CONDITIONSRE STATEMENT THAT THE THE RESPOSIBILTY FOR THE SAFTEY OF VISITORS TO THE PREMISES REST WITH OCCUPIER NAMELY ATS , WE ARE NOT THE ONLY OCCUPIER THERE ARE 10 OTHER BUSINESS WITHIN THE PROPERTY
WE DO HAVE PUBLIC LIABILITY BUT ARE NOT PREPARED TO SPEAK TO OUR INSURERS UNTILL YOU OR YOU CLIENT PROVIDES PROOF OF H & S AND PPE .funkyboogy
ParticipantRe: advice required
update guys , im still being chased with ambulance chasers on this .. sent them a letter stating i dont own the car park or the property , car park is size of a football park and that their are 17 other business on the property etc ..
i did also ask for their clients h&s and what ppe they had in place ..
received letter back 3/05th basically saying that im responsible for the carpark and the health & saftey and failed to grit the car park . they say their client fell at 11 am and that this was adequate time for me to assess the car park ??
they have said they will not supply the h&s and ppe request from myself and fail to see the relevance of it .
also that viola have have absolutely no control over the premises occupied by ourself
it also mentions that the owner of the property we rent have no responsibility for the saftey of visitors that rests with the occupier .. namely ourselfs – this is not true we are not the only occupier their are 10 other offices in the building ..
would appreciate a help with response letter
cheers ally
