You can go to the local county court if you so wish, taking the time off your busy day, missing calls and such like for the documentation to be processed and sent out.
I don’t see the point really. If you do it on line you can do it when it suits you, takes about 5 minutes to complete and the exact same result will occur. If the defendant, defends it, it is transferred to the local court, if they don’t defend it, you request judgement on line and it is then transferred to the local court to execute the warrant.
As a result of another job I do on a voluntary basis, I instigate many such claims, probably 3 or 4 a week, and I haven’t been into the local county court to start the proceedings for a couple of years now.
MUCH MUCH simpler to do it on line, but hey you pays your money you takes your chance.

Mike Hi
No problems.
Yes indeed an attachment of earnings order can most definitely be applied to someone on benefits. The 2007-2008 county court figures show that this type of order was most commonly applied to those in fact on benefits of one sort or another.
Its a long process to get sorted but it gets there in the end. Typically payments are low at around £2-£5 per week, but it gets you paid eventually. Unfortunately interest and such like cannot be claimed.
It also causes hassle to the defendant. They have to go to Court to swear their income details. They cannot just send in forms, so failure to attend results in an arrest warrant being issued. Attending and giving false declarations is the criminal act of perjury and attempting to pervert the course of justice.
Once the amount is decided, the payments are made to the court not the claimant (the court pass it on to the claimant) and so are tracked by the Court themselves. Failure of an employer to pay can lead to all sorts of problems for the employer so it pretty much guarantees you will get paid.

ParticipantRe: Fan in Blomberg double oven not working
Sorry there is not enough information to assist really.
Does the fan motor run when the main oven is selected?
In its very recent history, has the unit blown the electrics or trip in the house?
Is there any heat at all (even if only a small amount) when the main oven is selected?
Answering the above will assist in trying to identify the problem.
If you are going to work on the appliance yourself, please remember safety first and disconnect it from the mains supply.

ParticipantRe: Stolen rental washing machine.
Hi Guys
I think the county court system works well in cases like this. Use moneyclaim on-line for speed. If you action a claim before 4.00pm Mon – Fri, the defendant has it on their doorstep within 5 working days. If they do not respond within a further 14 days you can proceed to judgement on the 15th day (that’s days NOT working days), and once judgement is obtained in your favour proceed to instruct the court bailiff, a private bailiff or if the judgement is over £750.00 a High Court Sheriff.
Remember a couple of things, firstly, it is either the cost of the machine or the cost of the completion of the rental contract, whichever is the higher, that is the amount claimed, NOT the outstanding arrears. Once the defendant has defaulted as per your rental term and conditions agreed with the customer, write a LBA (Letter Before Action) giving them at least 7 clear days to clear the arrears and send it recorded delivery to the last known address of the defendant BEFORE you proceed to Court.
Second, basic domestic appliances, ie a cooker, washing machine and fridge. (not dishwasher, microwave and similar items) are now considered basic requirements for human life so a bailiff CANNOT automatically remove them from the defendant, even if it is your property. There are certain cirmcumstances when the bailiff can but these types of customer are unlikely to fall into that segment, so dont expect to win a judgement and then get your property back when the bailiff calls.
Where this occurs, the use of a Court Bailiff or High Court Sheriff as opposed to a private bailiff, is very important, The Court appointed enforcement officers, are required to advise the Courts of the reasons for not recovering the sums/goods concerned. This report allows you and the Courts to make an application for an attachment of earnings order. This particular order means that where ever the defendant is receiving an income, be it private from a job, or be it held in a bank account or if it comes from the tax payer in the form of benefits, a regular amount ordered by the Court can be deducted from that source.
Failure to comply with an attachment of earnings order is a Criminal Offence that in itself can lead to a six month prison sentence and or a £5000 fine, coupled with the fact that the original claim STILL has to be paid.
I seriously doubt anyone would take a risk on jail for the sake of a washing machine.
Our legal system can be very slow and it is up to the claimant to keep on top of pushing things through, but I believe ultimately it works.
The above information is valid only for claims within the English and Welsh Courts. Different rules apply in Scotland.
I hope this helps

ParticipantRe: 10 year warranty on LG direct drive motor.
Hi all
As with all things, a warranty is in fact a contract. A contract must be completed by both parties if it is to be relied upon later in life. The problem is the customer NOT completing the registration process of the appliance with LG customer services. The customer needs to do this so LG record the serial number and complete the contract.
Most customer ASSUME incorrectly that the process is automatic, it is not. If the serial number is not registered correctly at time of purchase, then LG will refuse the warranty, quite simple.
We have undertaken warranty work across the range of equipment supplied by LG and extended warranty on certain products has always been a sale feature they use, and each one has required the customer to register the appliance.
We have had many customers do this correctly and have never had a problem with the extended warranty as a result. Likewise we have had a great number of customer whom have not done it properly and quite rightly LG have refused to honour it.
Hope this helps clarify matters.
