Statute of limitations (yes it does exist in this country, its not just an America term) is 6 years from the date of last acknowledgement of the debt/credit.
Therefore, they are entitled to reclaim the amount if the original problem/issue took place between 16th September 2004 and today.
If it is older than this date, tell them they will need a Court Order to seek redress and watch them back off when they realised they cannot get one.

For me the important thing is honesty works BOTH ways, and in this case, from what I have read only, I don’t think RC behaved honestly.

We do exactly the same as Alex and charge the same rates, near enough.
We always bill the school directly. For us we usually do them during the school holidays, towards the back end of the main break. Unfortunately, we have to wait until the new term begins to get paid, but were used to it and know when the payments are coming through.
We have never done any PAT testing in the schools either, from what I understand the LEA does it for them.
One final thing which came up during the last round of contract negotiations, which might be pertinent was are our engineers CRB checked? We think this was because we also provide the breakdown service which means our engineers can be on site during school opening times.
Our engineers are checked and we repeat it every twelve months, but this is because we have a contract for working in a couple of prisons and they insist we are checked.

He is entitled to the same rights in consumer law, as if he purchased a new appliance, ie it must be fit for purpose and as described.
If he was present when it was delivered and signed to say so, tough for him.
Provided the item is fit for purpose (works correctly) and was as described (known by him to be of a second user condition and therefore with cosmetic imperfections) then he has no recourse back to you if he is now unhappy.
Difficulty will be explaining it to him and stopping him believing he is the proud owner of an ISE10 equivalent.

Well the last week has been an interesting one.
We have a new accounts manager looking after our account and things seem somewhat better. They have been communicating with us regarding issues which is welcome.
Our account has already been reconciled for this month (something unheard of previously) so provided the payment arrives when it should, it looks like they may have sorted themselves out.
We have even been receiving credits within a week of returning the parts to them, again something unheard of so lets hope this is the sign of things to come and if it is, well done and keep up the good work JTM.

Thankfully I haven’t had such a communication so I cannot throw it away. (I speak honestly and forthrightly about things so it wouldn’t be liked by some)
The whole thing mailshot and price slashing seems a tad desperate to me but that’s up to them.
For my two penny worth. the WTA has done more for me and this industry in the past couple of years than DASA has done in its entire existence, so I know where my subs will be going!
And it doesn’t get said very often so I am going to say it now. A big thank you to all the guys and gals looking after and administering the WTA for everything you do.
