Thanks for the help guys, still no luck in terms of testing, I’ve double checked the brushes, element all connections and not getting anything when setting any cycle.
The guy is only just back from a business trip so no major panic but with Xmas and the post being as it is I think my only way is to send the board off for analysis, do you agree?

Apologies for the delay in getting back to you to let you know how it all went in court.
As it happens the guy never turned up, instead he had faxed the court to say he was settling outside of it instead. This was on a Monday, the claim was to be heard on Wednesday.
I was unaware of his change of mind and ended up going to the hearing. After waiting around for an hour before going in I was told by the judge that the defendant had let the court know the matter had been settled (although the case had not been taken off the hearing list). The judge had in his hand a faxed copy of the defendant’s letter agreeing to pay the whole bill plus the court related costs I’d incurred up until the hearing (totalling £180).
I explained that the customer had not been in touch verbally and no cheque had been recieved. I reckon I had put a really strong case forward in my witness statement (if I do say so myself). Luckily someone was looking down favourably on me on the day and the judge accepted that as I had not been notified in time that I would be awarded the whole amount, all costs, loss of earnings and transport costs to get to the court. The overall figure topped £260!
Needless to say I had a few beers that night and couldn’t resist calling the customer at 9pm to say that he’d lost and that he should have made sure he sent the cheque special delivery on Monday. Incidentally the cheque came on the same day I was in court, all be it after I’d left. What mmade me laugh was that he’d put a second class stamp on it.
I did waste time and effort going forward with this, it’s not the first time I’ve taken things to the small claims court and each time have always won. As I said it was a matter of principle with me.
As always I appreciate all your help and interest, it’s nice to see that it generated so many opinions.

Thanks for all your advice, in hindsight no I wouldn’t bother but hey ho I really don’t like people who take advantage.
I can’t see how it is worth half a day off of work for the defendant but if he’s up for it so am I!
Maybe I should set up a book for bets aginst him/me. Is that against rules 😉

Thanks for your post, I should have kept everyone up to date with how things have moved on……
I’m seeing this through to the end, I’m in court a week tomorrow (24th March 2010). I’m pretty happy to go, it’s not my first time. My main trade is plumbing but ventured in appliance repair as a result of customer demand.
I have sued a couple of customers in the past, admittedly it was for more than £30.00. I’ve got a good feeling about this, especially given he has provided no written statement or provided evidence to back up his case.
As I’ve done in the past if successful I’ll claim lose of earnings and costs as well. It’s hardly a day out to the seaside but I’ll fight for what I believe is fair.
I’ll let you know how it goes!
